UK Cosmetic Regulations: What You Need to Know

On January 31, 2020, the United Kingdom and the European Union signed a cosmetic regulation. The changes will not have an impact on UK cosmetic regulations initially due to a transition period.

The period lasts for one year and, can be extended for an additional year as the EU and UK continue future trade talks.

Business owners concerned about Brexit should stay up-to-date on the latest changes in regulations.

Currently, EU regulations impact cosmetics that are distributed in the UK. Following the transitional period, the United Kingdom will be treated as a third country. The United Kingdom cosmetic companies will no longer have to comply with the regulations of EU member states.

New laws put forth to the parliament will allow cosmetic companies to be able to continue selling their products in Europe.

What does this mean for Your Cosmetics?

 

Current CPNP and EU RP notifications will remain valid, for UK Cosmetic regulations to apply decision has not been made yet. The key most important thing to understand is what will happen after the initial transitional period. A few of the changes include:

Companies will require to have a UK based “responsible person,” or RP, to make changes to the labels:

    • Add the UK person’s name and address
    • Do product notifications in the UK
    • Add “made in the UK” or “made in the EU” to the label
  • Mandatory to appoint a UK RP to the company through the transitional period
  • Notifications must persist for up to 3 months past the transitional period
  • Following Brexit, labels will be required to be updated before the 31st of December 2022

 

The current transitional period will come to a close on December 31, 2020. Companies must comply to the new rules after the transitional period.

As per UK cosmetic regulations Within 90 days, products notified through the CPNP will need to be notified in the UK SCPN. Notifications will require to provide the following:

 

  • Product name and category
  • Responsible person’s name and address
  • Ingredients and content in the product

 

Products that have EU-27 addresses will remain compliant in the EU for a period of two years. When dealing with imports, the UK will have to meet the regulations of the EU.

 

What Happens to UK cosmetic regulations If there is no brexit No Deal?

 

If there won’t be a deal in the Brexit UK cosmetic regulations, CPNP notifications carried out by UK responsible persons will need to be transferred to the EU-27 to remain valid.

Notifications would be mandatory for the European Union and the United Kingdom.

There may be additional changes in the future, so it’s important to continually keep on top of the changes and what will occur after the transitional period if no deal is reached.

 

It’s important to know that if there will be no deal, this will have a major impact on the cosmetic industry. There will be a great impact on products by a no-deal, but there are no details on the severity and fine details at the moment. There’s a lot of overlapping of the UK cosmetic regulations and EU regulations, so the impact may be different depending on the region.
