Canada-Based Responsible Person for Cosmetic Compliance
In Canada, cosmetic products are regulated under the Food and Drugs Act and the Cosmetic Regulations, which means every cosmetic product on the market must meet strict safety and labeling standards. Behind this compliance effort is the Responsible Person (RP)—an individual or entity tasked with ensuring that products align with Health Canada’s requirements.
Whether you’re a manufacturer, importer, or brand owner, understanding the role of the Responsible Person is crucial for ensuring your products are both legally compliant and safe for consumers.
What Does a Responsible Person Do?
At its core, the Responsible Person acts as the bridge between your product and Canadian regulatory authorities. They handle everything from ensuring the formulation is safe to dealing with Health Canada if questions or issues arise. In many cases, the Responsible Person is the only reason a product stays on shelves without running into compliance trouble.
Here’s a breakdown of their key responsibilities:
Filing the CNF
Before any cosmetic can be legally sold in Canada, a Cosmetic Notification Form (CNF) must be submitted to Health Canada within 10 days of first sale. The CNF designates a Canada-based Responsible Person — a requirement strictly enforced since March 2025. Read our complete CNF filing guide →
Ingredients Compliance
Canada’s Hotlist is a detailed document listing ingredients that are either banned or restricted in cosmetic products. The RP’s job is to make sure none of these prohibited ingredients are in your product and that restricted ones meet concentration and usage limits.
Ensuring Proper Labeling
Labeling a cosmetic product in Canada isn’t just about making it look good; it’s about meeting specific regulations. The Responsible Person ensures that: Labels are in both English and French. Ingredients are listed using INCI (International Nomenclature of Cosmetic Ingredients) names. Any required warnings or precautions are included. The product’s identity and net quantity are clearly stated.
Product Safety
Safety is non-negotiable. The RP oversees or conducts safety assessments for the product, ensuring that it’s suitable for its intended use and doesn’t pose a risk to consumers.
Handling Issues Post-Market
Even after a product is launched, the RP’s job isn’t done. They monitor for adverse reactions, consumer complaints, or any regulatory updates that might affect the product. If there’s a problem—like a recall or reformulation—they coordinate the necessary actions.
Record-Keeping
The Responsible Person is required to keep detailed records of formulations, safety data, and correspondence with Health Canada. These records must be maintained for at least three years after the product is discontinued.
Liaison with Health Canada
If Health Canada has questions about your product — or decides to conduct an inspection — the RP handles all communication. Cosmereg manages every Health Canada inquiry on your behalf, responding promptly and ensuring your products remain on the Canadian market without interruption.
March 2025: Canadian Address Now Mandatory
Since March 2025, Health Canada requires every CNF to list a Responsible Person with a physical Canadian address. Foreign brands can no longer satisfy this requirement with an overseas address — a Canada-based RP is now a legal requirement for selling cosmetics in Canada.
Why Is the Role of the Responsible Person So Important?
Taking on the Responsible Person role requires deep knowledge of Canadian regulations, a physical Canadian address, and constant attention to regulatory changes. Since March 2025, this is no longer optional — every foreign brand needs a Canada-based RP, or their CNF will be rejected and products cannot legally enter the market.
At Cosmereg, we specialize in cosmetic regulatory compliance. We act as your Canadian Responsible Person: filing your CNFs, screening ingredients against the Health Canada Cosmetic Ingredient Hotlist, maintaining compliance records, and responding to Health Canada on your behalf.
